No Vioxx class action lawsuit in the United States

Merck had always promised to aggressively fight any chance of Vioxx class action lawsuits. It failed miserably in Canada but Judge Eldon Fallon has ruled in favor of Merck in the US. "In this case, the difficulties in class management overwhelm any efficiencies that could be secured through classwide adjudication," he wrote in his decision. I think he has victims' interests in mind - in more than two years since the Vioxx was recalled, Merck is yet to pay a penny to any of the victims.
