Gerald Bennett wins Vioxx lawsuit
When Merck won the lawsuits filed by two victims – Stewart Grossberg and Elaine Doherty – you could see the glee on the faces of its legal team and the tone of its press releases. It was behaving almost as if it did nothing wrong, instead of being responsible for as many as 60,000 American deaths, according to a FDA expert’s estimates.
Looks as if it got a big slap on its face today when a federal jury ruled that not only should it pay at least $51 million in damages to a retired FBI agent, Gerald Barnett, but also declared that the company did not warn patients and doctors about the dangers of Vioxx. The compensation given in this case brings the average amount received by a victim to $25 million.
Mr. Barnett has had multiple surgeries on his heart since he took Vioxx, even though he was a relatively fit man.
And be prepared to hear from Merck that it will ferociously attack anyone who tries to ask for compensation (by the way, these people are Merck’s prior customers – and customers are always supposed to be kings), has done nothing wrong, and will continue to appeal till the world comes to an end. In another legal setback to the company, Frederick Humeston will get a new trial.
We are soon approaching the two-year anniversary of the recall of Vioxx and reports indicate that attorneys are busy helping victims meet the deadline of September 30 to file their lawsuits.
